Privacy Statement

This statement sets out the Zimbabwe Environmental Law Association’s (ZELA) website policy relating to the privacy of your personal information. It is to be read in addition to and with the Copyright Statement and Disclaimer. It is important to review the contents of this privacy statement as it may change to reflect user feedback, new developments in the law and new services or products and changes to the website.

USE OF PERSONAL DATA

If you choose to register to receive a free product from the ZELA website you will be asked to provide us with information that personally identifies you such as your name, organisation, e-mail address, telephone and fax number. This information is required so that ZELA can send you the information or render the service that you have registered interest in.
If you choose to purchase a service from the ZELA website through Bizgate (the South Australian Government Internet Payment Facility), or by sending us a cheque, money order or your credit card details, you will be required to provide us with financially sensitive and personally identifiable information such as your name, credit card and contact details. This information is required so that ZELA can process your transaction send you the product you have ordered.

CLICKSTREAM DATA

To enable ZELA to provide you with a website that is relevant and suitable to your needs, our service provider may record the following information for statistical purposes ONLY:

• The date and time of your visit to ZELA
• Your server address and
• The number of pages accessed or downloaded

NO attempt will be made, at anytime by ZELA to identify a user or their browsing activities from this information.

NO COOKIES

The ZELA website consists of static pages. It does NOT use cookies or session keys.

CONFIDENTIALITY AND DISCLOSURE.

ZELA will NOT use or disclose any personally identifiable confidential or sensitive information about you, without your consent, unless acting under a reasonable and good faith belief that it is necessary to:

• Enforce the Copyright and Disclaimer notices on the ZELA website;
• Protect the rights or property of the Zimbabwean government;
• Lessen or prevent a serious threat to a person's health or safety; or
• Comply with the laws of the country.

NO attempt will be made, at any stage during your visit to the ZELA website, to identify you EXCEPT in the event of an investigation, where a law enforcement agency has issued a warrant to inspect the logs of the internet service provider that facilitates the website.
ZELA will NOT disclose, sell, lease, hire out or rent any confidential and personally identifiable or sensitive information received from users of this website. This clause is to be read with the Liability Disclaimer clause set out below and our general Disclaimer statement.

SECURITY OF PERSONAL INFORMATION

ZELA has security measures in place to guard against the loss, misuse or alteration of confidential and personally identifiable or sensitive information, under our control. Remember that whenever you disclose information over the Internet or in a publicly accessible online forum, this information CAN and MAY be collected and used by hackers and others. Therefore while ZELA will take all reasonable steps to ensure that the information we collect from you is stored in a secure environment, WE CANNOT GUARANTEE that the data you transmit to us will not be lost, altered or misused. Therefore, any activities conducted using the ZELA website is to be undertaken at your ABSOLUTE SOLE RISK.

The ZELA website does provide links to third party websites. NOTE that ZELA does NOT operate or control these websites and that separate privacy statements apply to them. Ensure that you read the terms and conditions of these websites carefully BEFORE you disclose any personal information on them. This privacy statement ONLY applies to the ZELA website.

LIABILITY DISCLAIMER

Notwithstanding that ZELA will use all reasonable endeavours to protect and keep confidential any personally identifiable or sensitive information that you provide to us, if this information is accessed by a third party, whether by gross negligence or otherwise of ZELA, its employees, officers, agents, contractors, related bodies corporate, affiliates or associated organisations (to the extent permitted by law), ZELA will NOT be liable to you, or to any person claiming through you, in ANYWAY, for ANY loss, damage, costs, liability or other form of contribution.
